What this covers
Two kinds of content: (1) pages, articles and images on autosocialproof.com, which we publish, and (2) widget content that customers create in the app at https://app.autosocialproof.com and display on their own websites, such as review text, images, audio or video links. For customer content we act as a service provider: we can disable a widget, but the website it appears on belongs to the customer.
How to send a notice
Send a written notice that includes:
- Your physical or electronic signature, as the owner or a person authorized to act for the owner.
- Identification of the copyrighted work you say is infringed.
- The exact location of the material: the URL of the page on autosocialproof.com, or the website address where a widget shows it, plus a screenshot if you can.
- Your name, postal address, telephone number and email address.
- A statement that you have a good-faith belief that the use is not authorized by the owner, its agent or the law.
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are the owner or authorized to act for the owner.
Use the contact form (choose "Report misuse"), or the privacy email shown there behind the "Show email" button.
What we do next
We review complete notices promptly. Where a notice is valid we remove or disable the material, tell the customer who published it (for widget content) and keep a record. Incomplete notices get a reply explaining what is missing.
Counter-notices
If your material was removed and you believe that was a mistake or misidentification, you may send a counter-notice with: your signature; identification of the removed material and where it appeared; a statement under penalty of perjury that you have a good-faith belief it was removed by mistake or misidentification; your name, address and telephone number; and a statement that you consent to the jurisdiction of the federal court for your address (or, outside the US, any judicial district where TheBigBot LLC may be found) and will accept service from the person who sent the original notice. We may restore the material after 10 to 14 business days unless the complainant tells us they have filed a court action.
Repeat infringers
Accounts that repeatedly publish infringing material are closed under our acceptable use policy and terms of service.
False claims
Under 17 U.S.C. 512(f), anyone who knowingly misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages. If you are not sure whether material infringes your rights, consider getting legal advice first.
